The use of the website www.sunnycharter.it and the booking of the boat charter services offered by RUSSO LUCA<\/strong> are governed by the following Terms and Conditions of Sale. By making a booking, the user\u00a0 accepts these conditions in full and without reservation.<\/p>\n 1. Object of the Contract 2. Booking and Payment Methods<\/strong><\/p>\n Reservation<\/strong>:<\/p>\n During the “booking request” process, the Customer can select, from the available options, the desired departure port among those located along the Sorrento and Amalfi coasts, including the island of Capri, the date, the preferred vessel type, and the time. Port and time availability may vary and will be indicated during the booking process.<\/p>\n Payment<\/strong>: 3. Cancellations and Modifications<\/strong><\/p>\n Cancellation Policy<\/strong>: Refund in case of Adverse Weather Conditions<\/strong>:<\/p>\n In the event of weather conditions that make the performance of the Service objectively dangerous or impossible (for example, weather warnings issued by the Civil Protection, storm surges such as to prevent navigation assessed by the competent maritime authorities), the Owner reserves the right to cancel the Service in order to guarantee the safety of Customers and staff.<\/p>\n In this case, the Customer will have the right alternatively to<\/em>:<\/p>\n \u2022 100% refund of the amount paid; or The decision regarding the existence of adverse weather conditions and the possible cancellation of the Service lies with the Owner, who undertakes to promptly communicate the decision and the available options to the Customer.<\/p>\n Cancellation for other reasons:<\/strong><\/p>\n Except for the cases expressly provided for in this article (cancellation within the deadline or due to adverse weather conditions), no refunds will be provided for cancellations due to personal reasons of the Customer. However, the Customer may request to evaluate the possibility of changing the date of the Service, based on availability and subject to any price addition if the alternative Service chosen has a higher cost. The decision regarding changing the date remains at the discretion of the Owner.<\/p>\n Changing the booking date:<\/strong><\/p>\n The Customer may request a change to the booking date no later than 10 (ten) days before the originally scheduled date, without penalty. 4. Information about the Service<\/strong><\/p>\n Pre-Departure Instructions<\/strong>:<\/p>\n The day before the Service, the Customer will receive via email or via number phone (Whatsapp\/Imessage), at the address indicated during the booking phase, complete information relating to the address and exact location of the selected port of departure, together with the useful contacts of the assistance staff. Departure Place<\/strong>:<\/p>\n The boat charter services depart from the ports located along the coasts of Sorrento and Amalfi, including the island of Capri, which can be selected at the time of booking based on availability. The final port of departure will be confirmed in the booking summary email and in the pre-departure instructions.<\/p>\n 5. Responsibility RUSSO LUCA<\/strong> will not be responsible for failures or delays in the execution of the Service, nor for direct or indirect damages that may arise to the Customer, if such failures, delays or damages are caused by events of force majeure or unforeseeable circumstances, such as, by way of example and not limited to: natural disasters, adverse weather conditions as defined in the art. 3, strikes, provisions of public authorities, accidents or other unforeseeable and extraordinary events which prevent or make objectively dangerous the performance of the Service.<\/p>\n Limitation of Liability<\/strong>:<\/p>\n Without prejudice to the commitment to provide high quality Services, RUSSO LUCA<\/strong> will not be responsible for disservices or malfunctions directly attributable and unforeseeable to the External Service limited to the processing of secure payments, nor for actions or omissions of truly independent third parties and beyond the reasonable control of the Owner.<\/p>\n In any case, RUSSO LUCA<\/strong>‘s liability for any direct damages resulting from failure to fulfill contractual obligations will be limited to the maximum total amount paid by the Customer for the booked Service. In any case, liability for indirect, consequential damages or lost profits remains excluded.<\/p>\n 6. Final Provisions<\/strong><\/p>\n Applicable Law:<\/p>\n These Terms and Conditions are governed by Italian law.<\/p>\n Competent Court:<\/p>\n For any dispute relating to the interpretation, execution or validity of the contract, the court provided for by law will be competent.<\/p>\n Changes to the Terms:<\/p>\n RUSSO LUCA reserves the right to modify these Terms and Conditions at any time, for regulatory adjustments, modifications to the Services offered or for other legitimate reasons. The changes will be published on the Site and, in the event of substantial changes that significantly affect the rights of the Customer, the latter will be informed with adequate notice via email to the address provided during the booking and\/or publication of a clearly visible notice on the Site for at least 30 days. Use of the Service following the publication of changes constitutes acceptance of them.<\/p>\n Privacy and Data Processing:<\/p>\n

\nThis contract governs the booking and purchase of boat charter services offered on the Site. The contract is concluded between the Customer and RUSSO LUCA<\/strong>, with the sale and management of the reservation made externally to this site.<\/p>\n
\nPayment for Services is made via bank transfer to the Russo Luca company account or via link payment. Prices are expressed in euros and include VAT and any other applicable taxes, unless otherwise indicated.<\/p>\n
\nThe Customer has the right to cancel the reservation without penalty up to 10 days before the scheduled start time of the Service.
\nAfter this 10-day period, in the event of cancellation by the Customer, 100% of the amount paid will be retained.<\/p>\n
\n\u2022 Rescheduling of the Service on an alternative date, to be agreed with the Customer based on availability.<\/p>\n
\nThis change must be agreed upon in advance with Russo Luca and is subject to availability of the requested alternative dates.
\nIf availability is not available, the booking will remain valid for the originally scheduled date.<\/p>\n
\nThe Owner’s staff will be present at the port of departure to welcome the Customer and provide all the necessary information.<\/p>\n
